Chester County jury hears from Uber driver accused of raping passenger

WEST CHESTER, Pa. (KYW Newsradio) — An Uber driver, accused of raping a 21-year-old he had picked up at the Valley Forge Casino after she passed out in his car, took the stand in his own defense to say the contact was consensual. 

Ahmed Elgaafary, 27, is charged with rape of an unconscious person. His accuser testified she has no memory of the February 2018 ride from the Valley Forge Casino to her home in Malvern.

He testified she didn’t appear drunk when he picked her up, but when they got on Route 422, he had to pull over so she could throw up.

When they got back in the car, he said she started crying over an ex-boyfriend, then started touching his neck asking if he liked American girls.

When he stopped to try to figure out her directions, he said she had her dress hiked up and invited him to join her in the back seat where he said they kissed and had sex.

He said less than five minutes later, when they got to her house, she had thrown up all over his back seat and was passed out. It took him a few times to wake her up and he helped her to her house.

Prosecutors showed photos of the woman he had taken after she’d thrown up on the back seat, where she appears to be asleep and unresponsive.
